UAE Work Permits, Visas, Labour Cards, Employment and Contracts
In the UAE, there are several recruitment agencies licensed to recruit foreign manpower. These agencies are subject to specific conditions, they may not receive any fees from the workers in consideration of the brokerage to find them a job and receive remuneration from the employers who ask them to call for labour from abroad.
Work Permits
To obtain a work permit, the foreign worker should be sponsored by an establishment licensed and registered with the Ministry of Labour. The Ministry of Labour issues the work permit under specific terms, and the worker should fulfill the conditions shown below:
- The worker should be between 18 & 60 years of age.
- The worker should have professional or academic qualifications useful to the U.A.E.
- The worker should hold a passport valid for at least six months.
- The worker should be medically fit & not suffering from any illness.
Employment Contracts
As workers arrive to the UAE, he/she should have an employment contract from the employer. The contract should be written in Arabic or English. The employment contract should be made in three copies, one to be kept with the worker, another with the employer and the third with the competent labour department. The employment contract should state the date of commence, type, place, term, duration and salary. The competent Labour Department will review and certify the employment contract.
Visit Visas
To visit the UAE, you must obtain a visa from a sponsor. The sponsor can be a company, individual or hotel. To sponsor a visit visa, the individual must earn over 3,000 AED per month and hold a valid residence visa. GCC citizens and British nationals can enter the UAE without a visa. Visas are valid for 60 days, renewable once up to a total of 90 days.
To obtain a visit visa from a UAE embassy you are required to present the following:
- A passport valid for at least 6 months
- 2 passport photos
- 2 filled application forms
- Letter or fax from the sponsor in the UAE to the related embassy
- A letter from the applicant's company
Visit visas and transit visas are deposited at the airport immigration counter right before flight arrivals and are collected by visitors at the immigration counter after presenting the passport.
All residents of GCC countries holding a valid resident visa and of managerial positions can obtain 30-day visit visas upon arrival to the UAE. It normally takes 7 to 10 days for a visit visa to be issued.
Labour Cards
The Employer must obtain a labour card for the recruited worker within 60 days of the worker’s arrival date to the U.A.E. Should the employer fail to do so, he/she is subject to fines. In such circumstances, it is advisable to notify the competent labour department to take necessary actions against the employer. Worker must be medically fit to perform the work he/she was hired for and should not be suffering from any disease. This must be certified through a medical certificate for each worker, issued by a competent medical entity in the UAE
Labour cards are valid for three years and are renewable for a similar period with the consent of the employer and the worker. In this case, UAE labour cards must be renewed within 60 days from the expiry date. Workers are not allowed to work after the expiry of the labour card.
Since workers are usually the ones that would suffer the prejudice arising from the non-renewals of the labour card, it is advisable to notify the competent labour department to take the necessary procedure against the employer if the labour card was not renewed. The employer undertakes to pay the fees due on the employment contract and the labour card as well as the fines due on the failure to obtain or renew the labour card within the defined delays.
Residence Visas
Residence visa formalities are normally handled through employment companies. Family and dependents are usually sponsored by husbands owning companies in UAE provided the salary of the husband is above 4,000 AED. A medical test, including blood test and x-ray tests for chests, is also required. Employers usually withhold employee's passports at the company premises and passports are returned to employees upon leaving the UAE.
Transit Visas
Transit visas to the UAE are normally issued for 15 days only and are normally sponsored by a company based in the UAE. Large hotels and tourist-related companies are allowed to sponsor transit visas for tourists and business men. Transit visas can also be obtained through airline reservation companies for passengers passing through the UAE on transit. Transit visas usually provide passengers with the ability to pass into the UAE for a few.
Employment Contract Termination
The employment contract is terminated in any of the cases listed below:
- If both parties agree to terminate the contract provided that this is done in writing.
- Upon contract expiry unless the contract is expressly or implicitly extended.
The employer may dismiss the worker without notice in the following cases:
- If the worker adopts a false identity, nationality or if he/she submits forged documents or certificates
- If the worker commits an error causing substantial material loss to the employer provided that the latter advises the labour department of the incident within 48 hours.
- If the worker violates instructions concerning safety as long as these instructions are displayed in writing at conspicuous places.
- If the worker fails to perform his/her basic duties under the contract of employment and persists despite formal investigation and warnings
- If the worker exposes any business-related or job secrets
- If found drunk during working hours or under the influence of drug.
- If the worker commits an assault on the employer, the manager or any of his/her colleagues
- If the worker was absent without legitimate excuses for more than 20 intermittent days or for more than seven successive days during one year.
